We’re often asked, ‘Is stealing fuel a criminal offence?’ and the answer is yes. In England and Wales, stealing someone else’s fuel can be treated as theft under the Theft Act 1968, which is why suspected fuel theft should be taken seriously and investigated carefully.
A sensible investigation starts by establishing whether theft has actually occurred, as not every unexplained discrepancy is linked to criminal activity. This means meticulously looking at the available information, which, depending on the circumstances, could involve:
Comparing the vehicle’s recent fuel consumption with its usual performance and using telematics records to identify legitimate reasons for fuel consumption changes (e.g. traffic conditions, route changes, extended periods of idling, etc.).
Reviewing fuel-card transactions and fuel purchases against the vehicle’s mileage, expected fuel consumption and operating schedule to identify anything unusual.
Inspecting the vehicle, checking the fuel tank, filler area and associated components for signs of interference, damage or other indications that the tank may have been accessed.
Gathering and reviewing evidence like CCTV footage, depot records, parking locations or other relevant information that may help build a clearer picture of what has happened.
